Terms and Conditions

Sharing Stream provides users with access to a wide collection of resources, including various communication tools, forums, purchasing services, search services, personalized content, and brand programming through its network of properties that can be accessed through any means or device now known or developed in the future (“the service”).

You also understand and agree that the Service may include advertisements, and that these advertisements are necessary for Sharing Stream to provide the Service. You also understand and agree that the Service may include certain Sharing Stream communications, such as service announcements, administrative messages, and the Sharing Stream Bulletin, and that these communications are considered part of the Sharing Stream membership and you may not opt out of receiving them. Unless explicitly stated otherwise, any new feature that increases or improves the current Service, including the publication of new Sharing Stream properties, will be subject to the Terms of Service.

You understand and agree that the Service is provided “AS IS” and that Sharing Stream assumes no responsibility for the timeliness, deletion, incorrect delivery, or lack of storage of communications or user personalization settings. You are responsible for obtaining access to the Service, and that access may include third-party fees (such as the Internet service provider or time-of-use charges). You are responsible for those rates, including those associated with the display or delivery of advertisements. Additionally, you must provide and are responsible for all the equipment necessary to access the Service.

When considering your use of the Service, you declare that you are of legal age to form a binding contract and that you are not prohibited from receiving services in accordance with the laws of the United States or other applicable jurisdictions.

You also agree to:

Provide true, accurate, current, and complete information about yourself as requested by the Service registration form (the “Registration Data”) and promptly maintain and update the Registration Data to ensure it remains true, accurate, current, and complete. If you provide any false, inaccurate, outdated, or incomplete information, or if Sharing Stream has reasonable grounds to suspect that such information is false, inaccurate, outdated, or incomplete, Sharing Stream has the right to suspend or cancel your account and reject any and all current or future use of the Service (or any part thereof).

Sharing Stream is concerned about the security and privacy of all its users, especially children. Please note that the Service is designed to attract a wide audience. Therefore, as a legal guardian, it is your responsibility to determine if any areas of the Service and/or the Content (as defined in Section 6 below) are appropriate for your child.

Registration data and certain information about you are subject to our Privacy Policy. For more information, please refer to our complete privacy policy in the Privacy Policy section. You understand that by using the Service, you accept the collection and use (as outlined in the Privacy Policy) of this information, including the transfer of such information to the United States and/or other countries for storage, processing, and use by Sharing Stream and its affiliates.

Upon completing the Service registration process, you will receive a password and an account designation. You are responsible for maintaining the confidentiality of the password and account, and you are fully responsible for all activities conducted with your password or account.

You agree to:

• Notify Sharing Stream immediately of any unauthorized use of your password or account or any other security breach.
• Ensure to log out of your account at the end of each session.

Sharing Stream cannot and will not be liable for any loss or damage arising from your breach of this Section 5.

You understand that all information, data, text, software, music, sound, photographs, graphics, videos, messages, labels, or other materials (“Content”), whether public or transmitted privately, are the sole responsibility of the person from whom said Content originated. This means that you, and not Sharing Stream, are fully responsible for all Content that you upload, post, email, transmit, or otherwise make available through the Service. Sharing Stream does not control the Content published through the Service and, as such, does not guarantee the accuracy, integrity, or quality of such Content. You understand that by using the Service, you may be exposed to offensive, pornographic, indecent, or objectionable Content.

Under no circumstances will Sharing Stream be liable in any way for any Content, including, but not limited to, any error or omission in any Content, or any loss or damage of any kind incurred as a result of the use of any posted Content, sent by email, transmitted, or made available through the Service.

The use of the myownfreehost product requires that abuse emails be forwarded to info@sharingstream.com, or that abuse tickets increase. Failure to comply is a serious violation of these Terms.

You agree not to use the Service to:

– Upload, publish, send by email, transmit, or otherwise make available any Content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of privacy, hateful, or racially, ethnically, or otherwise objectionable; harm minors in any way; impersonate any person or entity, including, but not limited to, a Sharing Stream official, a forum leader, a guide, or a host, or falsely declare or otherwise misrepresent your affiliation with a person or entity; falsify headers or manipulate identifiers to hide the origin of any Content transmitted through the Service; upload, post, email, transmit, or otherwise make available any Content that you do not have the right to make available under any law or under contractual or fiduciary relationships (such as privileged information, confidential and proprietary information disclosed as part of labor relations) or under non-disclosure agreements; upload, publish, email, transmit, or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights (“Rights”) of any party; This includes linking or redirecting to any content or copyright files hosted on a third-party server/resource. upload, publish, send by email, transmit, or make available any unsolicited or unauthorized advertising, promotional materials, “spam,” “spam,” “chain letters,” “pyramid schemes,” or any other application form, except in those areas (such as purchases) that are designated for that purpose (read our full Spam Policy); upload, publish, email, transmit, or make available any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or equipment telecommunications; upload, post, email, transmit, or otherwise make available any material that is of the type of transmission/transmission.

– Upload, publish, email, transmit, or make available any material that is keylogging/proxy service/irc/shell(s) if there is any type/file hosting/file sharing types. Upload, publish, email, transmit, or otherwise make available any material about free hosting accounts that are pornographic in nature. This excludes premium paid hosting accounts (cPanel/WHM hosting accounts).

– Interfere or interrupt the Service or servers or networks connected to the Service, or disobey the requirements, procedures, policies, or regulations of the networks connected to the Service; intentionally or unintentionally violate any applicable local, state, national, or international law, including, among others, the regulations promulgated by the US Securities and Exchange Commission, any rule of any national or other exchange of values, including, without limitation, the New York Stock Exchange, the Stock Exchange.

When you sign up for Sharing Stream, you acknowledge that by using the Sharing Stream services to send electronic communications (including, but not limited to, email, uploading photos and files, and other Internet activities), it will cause communications to be sent through the Sharing Stream computer networks, parts of which are located in California, Ohio, the United Kingdom, and other locations in the United States, as well as abroad. As a result, and also due to the network architecture and commercial practices of SharingStream and the nature of electronic communications, even communications that appear to have an intra-state nature may result in the transmission of interstate communications, regardless of your physical location at the time of transmission. Consequently, by accepting these Terms of Service, you acknowledge that the use of the service results in transmissions of interstate data.

By acknowledging the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside.

Sharing Stream does not claim ownership of the Content it sends or makes available for inclusion in the Service. However, with respect to the Content that it sends or makes available for inclusion in areas of the Public Access Service, it grants Sharing Stream the following licenses worldwide, royalty-free, and non-exclusive, as appropriate:

With respect to the Content that it sends or makes available for inclusion in public access areas of the Sharing Stream Servers, the license to use, distribute, reproduce, modify, adapt, publicly perform, and publicly display said Content in the Service for the sole purpose to provide and promote the Sharing Stream Service to which said Content was sent or made available. This license exists only as long as you choose to continue including such Content in the Service and will terminate at the time you delete or Sharing Stream delete such Content from the Service.

With respect to the photos, graphics, audio, or video that you send or make available for inclusion in areas of the Service accessible to the public other than the Sharing Stream servers, the license to use, distribute, reproduce, modify, adapt, perform publicly, and publicly display said Content on the Service solely for the purpose for which said Content was sent or made available. This license exists only as long as you choose to continue including such Content in the Service and will terminate at the time you delete or Sharing Stream delete such Content from the Service.

With respect to Content other than photos, graphics, audio, or video, you send or make available for inclusion in areas of the Service accessible to the public other than the Sharing Stream Servers, the perpetual, irrevocable, and fully sublicenseable license to use, distribute, reproduce, modify, adapt, publish, translate, publicly perform, and publicly display said Content (in whole or in part) and incorporate said Content in other works in any format or medium now known or subsequently developed.

The “publicly accessible” areas of the Service are those areas of the Sharing Stream property network that are intended to make Sharing Stream available to the general public. As an example, the public access areas of the Service would include the Sharing Stream message boards and all areas that are open to both members and visitors. However, the areas of public access to the Service would not include parts of the Sharing Stream servers that are limited to members, the Sharing Stream services intended for private communication such as Sharing Stream Mail, or areas outside the Sharing Stream network of properties as parts of sites of The World Wide Web which are accessible through hypertext or other links but are not hosted or served by Sharing Stream.

By submitting ideas, suggestions, documents, and/or proposals (“Contributions”) to Sharing Stream through its forum or contact forums, you acknowledge and agree that:

• Your contributions do not contain confidential or proprietary information.
• Sharing Stream is under no obligation of confidentiality, expressed or implied, regarding Contributions.
• Sharing Stream shall have the right to use or disclose (or choose not to use or disclose) such Contributions for any purpose, in any way, in any means of communication worldwide.
• Sharing Stream may have something similar to Contributions that are already under consideration or in development.
• Your Contributions automatically become the property of Sharing Stream without any Sharing Stream obligation to you.
• You are not entitled to any compensation or refund of any kind from Sharing Stream under any circumstances.

You agree to indemnify and hold Sharing Stream and its subsidiaries, affiliates, officers, agents, employees, partners, and licensors harmless from any claim or demand, including reasonable attorney’s fees, made by a third party as a result of Content you submit, post, transmit, or otherwise make available through the Service, your use of the Service, your connection to the Service, your violation of the Terms of Service, or your violation of any rights of another.

You agree not to reproduce, duplicate, copy, sell, exchange, resell, or exploit for commercial purposes any part of the Service (including your Sharing Stream ID), use of the Service, or access to the Service unless you are a member of the Sharing Stream reseller service, which uses the resale platform to resell to end-users.

You acknowledge that Sharing Stream may establish general practices and limits related to the use of the Service, including, but not limited to, the maximum number of days the Service will retain inactive hosting accounts, message board publications, or other Content uploaded, the maximum number of emails that can be sent or received by an account in the Service, the maximum size of any email message that can be sent or received by an account in the Service, the maximum disk space that will be assigned on the Sharing Stream servers on your behalf, and the maximum number of times (and the maximum duration for which) you can access the Service in a given period of time. You agree that Sharing Stream has no responsibility or obligation for the deletion or lack of storage of messages and other communications or other Content maintained or transmitted by the Service. You acknowledge that Sharing Stream reserves the right to log out accounts that are inactive for an extended period of time. Additionally, you acknowledge that Sharing Stream reserves the right to modify these general practices and limits from time to time.

 You agree that Sharing Stream may, under certain circumstances and without prior notice, immediately terminate your Sharing Stream account, any associated email address, and access to the Service. The reasons for such termination may include, but are not limited to:

– Breaches or violations of the TOS or other agreements or guidelines incorporated.
– Requests by law or other government agencies.
– Self-initiated account deletions by you.
– Discontinuation or substantial modification of the Service (or any part thereof).
– Unexpected technical or security problems.
– Prolonged periods of inactivity.
– Your participation in illegal or fraudulent activities and/or failure to pay any fees owed for the Services.

Termination of your SharingStream account includes:

– Revocation of access to all features within the Service, including but not limited to Hosting accounts, Email services, and SQL databases.
– Deletion of your password and all related information, files, and content associated with or within your account (or any part thereof), unless the Service is still in use.

Additionally, you agree that all terminations for cause will be made at the sole discretion of Sharing Stream, and Sharing Stream will not be liable to you or any third party for the termination of your account, any associated email address, or access to the Service.

Your correspondence or business relationships with, or participation in promotions of, advertisers who are in or through the Service, including payment and delivery of related goods or services, and any other term, condition, warranty, or representation associated with such transactions, are solely between you and such advertiser. You agree that Sharing Stream will not be responsible for any loss or damage of any kind incurred as a result of such transactions or as a result of the presence of such advertisers in the Service.

The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because Sharing Stream has no control over such sites and resources, you acknowledge and agree that Sharing Stream is not responsible for the availability of such external sites or resources, and does not endorse or take responsibility for any Content, advertising, products, or other materials found on or available through such sites or resources. Additionally, you acknowledge and agree that Sharing Stream will not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such Content, goods, or services available on or through any such site or resource.

Share intellectual property rights

You acknowledge and agree that the Service and any necessary software used in connection with the Service (“Software”) contain proprietary and confidential information that is protected by applicable intellectual property and other laws. Additionally, you acknowledge and agree that the Content contained in sponsor advertisements or in the information presented through the Service or by advertisers is protected by copyright, trademarks, service marks, patents, or other property rights and laws. Except as expressly authorized by Sharing Stream or advertisers, you agree not to modify, rent, lease, lend, sell, distribute, or create derivative works based on the Service or the Software, in whole or in part.

Refunds are issued at the sole discretion of Sharing Stream. Sharing Stream reserves the right not to issue a refund. The client acknowledges that hosting payments are non-refundable. For instance, if the Client makes a payment for twelve (12) months of service, the service will be provided for twelve (12) months, and no refund will be issued if the client decides to suspend the service with Sharing Stream midway through the term. Payments deemed fraudulent, verifiable as fraudulent, and confirmed as fraudulent may be eligible for a refund, subject to the terms and conditions of the payment provider, such as PayPal,  2Checkout or Stripe
